MP's staff – Kyle Evans

Request

Nuneaton and Bedworth Councillor Kyle Evans places on his declaration of interests that he works for UK Parliament. I understand he is a case worker for an MP and he advised that IPSA would tell me which MP he worked for if I put in a FOIA. It is reported at he is a case worker.

  1. Please provide information on which MP(s) Kyle Evans works for paid for by the public.

  2. Please provide information if this employment is full or part-time.

  3. Please provide information related to if he was on leave on 25th November 2021.

I can confirm that IPSA holds information relevant to your request.

The information which you have requested is subject to a refusal notice under FOIA sections 40(2) and (3) and in accordance with Section C of IPSA’s Publication Policy, which can be found on our website.

Sections 40(2) and 40(3A)(a) – personal data

This exemption applies to information which IPSA considers to be personal data within the meaning of Article 4(1) of the UK General Data Protection Regulation 2016 (UK GDPR) which states:

‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly

IPSA considered that the following are personal data within this definition

  1. information about which MP(s) Kyle Evans works for

  2. the nature of any contract

  3. dates of annual leave

We then considered whether disclosure of this personal data would breach any of the Principles relating to the processing of personal data in the UK GDPR. The relevant principle falls at Article 5(1)(a):

Personal data shall be:

a. Processed lawfully, fairly and in a transparent manner in relation to the data subject

As IPSA was unable to find a lawful basis on which it could rely, within Article 6 of the UK GDPR, it therefore finds that the information requested is exempt from disclosure under section 40.

FOIA section 40(5) further exempts public authorities from the duty to confirm or deny whether the information is held, if doing so would contravene any of the data protection principles. As Councillor Evans’ employment at the UK Parliament Employment has been publicly declared on the “Nuneaton and Bedworth Borough Council Register of Councillor’s Interests”, IPSA found that simply confirming the fact that IPSA holds information relating to this employment, without disclosing any details, would not contravene data protection principles.

Although we have not provided the information requested, IPSA publishes general information concerning MPs’ staffing and business costs’ on our website.
