Details of staff disciplinaries at IPSA

  • Please provide a breakdown showing the number of discipline cases for 2015, 2016, 2017 and to date in 2018, together with the charge type.

  • Please disclose how many written warnings etc were given and for dismissals please disclose the charge type which led to the dismissal.

IPSA holds the information that you request.

Under our disciplinary procedures, details of disciplinaries and any written warnings issued are regarded as ‘live’ before being removed from an individual’s electronic record. As such, we hold an electronic record of one disciplinary in 2017 which led to a written warning.

As we are a small organisation, it is likely that disclosure of the charge type would identify individuals involved. Information which could lead to the identification of living, identifiable individuals is their ‘personal data’. We consider that identification would likely lead to distress to the individual concerned, in breach of the fair processing principle (Principle 1) of the DPA, where it would be unfair to those persons or is confidential. As such, we are withholding this information under section 40(2) of the FOIA. It is possible that information relating to written warnings and dismissals may be held in hard copy employee files. Our HR team have calculated that the cost of conducting a search to identify and extract this information would exceed the appropriate cost limit of £450 (part 1 of Schedule 1 of the Freedom of Information Act).  Consequently, IPSA is not able to respond to your request (see section 12(1), FOIA).
