Implementation of various equality acts

Request

FOI Request/ Standard Request re House of Lords Select Committee on the Mental Capacity Act 2005; the Equality Act 2010; the Mental Health Act 1983; the Data Protection Act 1998; the UN Convention on Human Rights for people with disabilities

In connection with this, I wish to request the following information, please:

1] Your "Best Interests" Decision-Making Policy;

2] Your Mental Capacity Act 2005 Policy;

3] Your details provided to the House of Lords Select Committee on the Mental Capacity Act 2005;

4] Your details of the evidence given to the House of Lords Select Committee on Mental Capacity Act 2005;

5] Your details of how you and your staff and/or agents and/or registrants can prove that they have understood how the Mental Capacity Act 2005 can be legally effected;

6] The statistics, if any, of how many of you and your staff and/or agents and/or your registrants have proved that they understood the full implementation of the Mental Capacity Act 2005 since its enactment, and subsequent amendments;

7] Details of all your policies, codes of practice and regulations concerning the Mental Capacity Act 2005; the Mental Health Act 1983; and the DOLS interface between the Mental Capacity Act 2005 and Mental Health Act 1983;

8] Details of your policies on implementation of the Equality Act 2010;

9] Details of your policies on implementation of the Data Protection Act 1998;

10] Details of your policies on implementation of the UN Convention on Human Rights and people with disabilities.


Response

IPSA holds some of the information that you request.

We comply with legislation that lays down requirements on employers and have policies in place on how these apply to IPSA. IPSA’s equality and diversity policy document (attached at Annex A) provides more detail on the policies we have in place in relation to the relevant legislation, including the Equality Act 2010.

In accordance with our publication policy and within our approach to handling requests under the Freedom of Information Act 2000, any processing of personal data is handled in accordance with the Data Protection Act 1998.

We do not have policies that specifically relate to either the Mental Capacity Act 2005 or to the Mental Health Act 1983 as this legislation, as we understand, does not confer requirements on IPSA as an employer. 

IPSA has not been requested to provide evidence to the House of Lords Select Committee on the Mental Capacity Act 2005.
