Legal advice sought by IPSA in relation to mortgage interest repayments

You specifically requested legal advice sought by IPSA “in drawing up the rules relating to notional capital gains on Members’ properties (i.e those who were in receipt of mortgage interest subsidy from May 2010 concluding in August 2012)."

IPSA holds the information that you request.

We are withholding this information under Section 42 (1) of the Freedom of Information Act which states that “Information in respect of which a claim to legal professional privilege or, in Scotland, to confidentiality of communications could be maintained in legal proceedings is exempt information.”

Section 42 provides an exemption for information which is subject to legal professional privilege protecting the ability for a client to obtain free and frank legal advice from legal advisors. We have considered whether the public interest in maintaining the exemption outweighs the public interest in disclosure and concluded that the balance is in favour of withholding the information.
